Consent is an agreement between people for something to happen. Sexual consent is when a person has the ability and freedom to agree to sexual activity.
Everyone involved in sexual activity needs to consent at all times. That applies regardless of your gender and whether you identify as LGBTQ+. Sex or sexual activity can include kissing, sexual touching, oral, anal and vaginal sex with a penis or with any other type of object.
Consent cannot be given by a person who is:
-
- Underage
-
- Drunk or has taken drugs
-
- Asleep or unconscious
Consent has to be freely given. If someone is intimidated or threatened into saying ‘yes’ to sex, that isn’t considered consent because it was not given freely. Unequal power dynamics, such as engaging in sexual activity with an employee or student, also mean that consent cannot be freely given.
If there is sex without consent, this is rape. If sexual activity happens without consent, this is sexual assault.
